Terms of Service
The rules of engagement. Clear, transparent, and human-friendly agreements for building exceptional digital products together.
Welcome to KhalidBuilds Studio! These terms explain the ground rules for working together on your custom web and digital projects. By hiring us or using the KhalidBuilds Studio services, you agree to these simple rules.
1. Acceptance of Terms
By using our website or hiring us for a project, you're agreeing to the terms outlined below. If you don't agree with them, please don't use our services.
2. Scope of Services
We build custom websites, web apps, and digital solutions. Everything we agree to build for you will be clearly written down in a project proposal.
Project Proposals
Each client gets a clear proposal showing exactly what we will build.
Extra Features
Need changes not in the original plan? No problem! We'll just give you a separate quote for the extra work.
3. Payments & Fees
We like to keep money matters simple and completely transparent.
- The 40/60 Split: Once you review and approve the basic MVP (Minimum Viable Product) and our quote, we ask for a 40% upfront payment to kick things off. You pay the remaining 60% only when the project is fully finished and you are happy with it, right before we hand over the final code.
- Non-Refundable Upfront Payment: That first 40% payment is non-refundable. It secures our time and covers the heavy lifting of starting your project.
- Late Payments: We won't hand over the final source code or launch the site until the final invoice is paid in full.
4. Return & Refund Policy
Because we write custom code specifically for your business, we cannot simply "take it back" like a physical product in a store. Here is how we handle refunds:
Non-Refundable Deposit
As mentioned, your 40% upfront payment is non-refundable because work starts immediately.
Delivered Code
Once you pay the final balance and we hand over the project, the deal is done. We don't accept returns for delivered code.
Cancellations: You can cancel the project at any time. If you do cancel midway, you won't get the 40% upfront money back, but you also won't owe us the remaining 60% balance.
Post-Launch Support: Your post-launch support depends on the specific plan you choose. You can see the exact duration of support included in each plan in our Pricing section. Once that period ends, you have to pay accordingly for any further support.
5. Intellectual Property & Code Ownership
Once your final bill is paid, you own 100% of the final deliverables, designs, and the custom code we wrote for you.
However, we do keep the right to:
- Use open-source tools or pre-existing code libraries that we brought to the project.
- Show off the awesome work we did for you in our portfolio (unless we signed a strict Non-Disclosure Agreement).
6. Domain Ownership & Legal Responsibility
You Own Your Domain
The domain name (website address) is registered in your name and fully owned by you.
Legal Responsibility
You are solely responsible for all content, legal disputes, and compliance related to your domain.
Total Responsibility: Since you are the legal owner of the domain, any legal matters, copyright infringements, or illicit activities occurring on or connected to the domain are completely your responsibility. KhalidBuilds Studio simply writes the code; we do not own the domain, nor are we liable for how it is used.
7. Warranties and Maintenance
We take pride in our work and make sure everything runs exactly as promised in the proposal. You'll have plenty of time to test the project before making your final payment.
Post-Launch Support: The post-launch support you receive depends entirely on the plan you choose, which you can see in our Pricing section. We provide support as per the duration mentioned in your selected plan. If you want ongoing support or maintenance after your plan's support period ends, you will have to pay accordingly via a separate hourly fee or a new maintenance agreement.
8. Limitation of Liability
We do our best to build secure and reliable software, but technology can be unpredictable. This section limits our legal and financial risk:
- No Indirect Damages: If your website goes down, if a third-party service (like your hosting provider or a payment gateway) fails, or if you lose out on sales/profits due to a bug, we are not responsible for covering those financial losses.
- Maximum Liability: If there is ever a major dispute where we are found legally at fault, the absolute maximum amount we would ever owe you is the total amount you paid us for that specific project.
9. Project Termination
If either of us breaks this agreement, the other person can walk away. If you decide to cancel the project halfway through, we keep the initial deposit for the work already done, but we part ways cleanly.
